After several years of signature collection on State initiatives (scroll down to #921; PDF of language), there has not been enough public interest or support to get this issue on the ballot.

Since the law cannot protect your children, teach them to fight back to the best of their ability.

Only a vigorous personal self-defense can hope to protect your children from dying at the hands of violent sex offenders.

COEUR D'ALENE -- Kootenai County prosecutors have accepted the plea deal offered by Joseph Duncan's attorneys. The new plea deal will have Duncan plead guilty to 3 counts of first degree murder, 3 counts of first degree kidnapping, waive his right to extradition and future court appeals. Duncan will also give up all passcodes to encrypted data on his computer.

In exchange, Duncan would serve at least 3 life sentences and could still face the death penalty in Kootenai County if Federal prosecutors fail to get a death penalty conviction. That outcome will not be known until Duncan's Federal charges are faced.

Late Sunday evening, the Kootenai Co. Sheriff's Office announced jury selection is cancelled on Monday. Capt. Ben Wolfinger tells KREM 2 North Idaho reporter Erik Hedlund he attended a meeting with First District Judge Fred Gibler on Sunday, who called a court hearing at 9am Monday morning.

SPOKANE, Wash. -- Lawyers for Joseph Edward Duncan III said Wednesday he will admit to the murder of 9-year-old Dylan Groene at a campsite in Montana and to three slayings in Idaho if state prosecutors will agree not to seek the death penalty.

In a letter to Prosecutor Bill Douglas of Kootenai County, Idaho, Duncan's lawyers said their client will cooperate fully with law enforcement officers, even though what he says will likely be used against him if he faces a possible death sentence in federal court later.

"Mr. Duncan will admit to the intentional killing of Dylan Groene in Montana in the early part of 2005, as well as all other crimes committed against Shasta and Dylan Groene," said the letter signed by public defenders John Adams and Roger Peven.

Peven, head of the federal public defenders office in Spokane, said Douglas has rejected the offer.

Douglas did not immediately respond to a request for comment from The Associated Press. A spokeswoman in his office said he did not want to comment since jury selection in the case begins Monday.

"We're ready to go on the 16th," she said.

Douglas has consistently rejected a plea bargain for Duncan. Steve Groene, father of the abducted children, in recent months has asked for a plea bargain so Shasta, now 9, would not have to face Duncan in court. Steve Groene is recovering from recent throat cancer surgery and was not immediately available for comment Wednesday.

Duncan is accused of killing the children's mother, their 13-year old brother, and their mother's boyfriend in May 2005 at their home near Coeur d'Alene, Idaho.

Court documents allege Duncan, 43, a Tacoma native who spent most of his adult life in Washington prisons for sexual crimes against children, committed the slayings so he could kidnap the two children for sex.

Duncan allegedly took the two children to a primitive campsite in Montana and Dylan was killed at some point. Shasta, 8 at the time, was rescued at a Denny's restaurant in Coeur d'Alene after seven weeks of captivity.

Peven said Duncan is willing to plead guilty to spare Shasta the trauma of facing him in court.

"It's the right thing to do," Peven told The Associated Press. "Mr. Duncan doesn't advantage himself in any way."

A guilty plea would eliminate an anticipated two decades of appeals in which Shasta, the sole survivor of the carnage, would have to face Duncan in court, Peven said.

Duncan understands that by making the confessions, he will make it easier for the federal government to convict him of expected charges of kidnapping and murder in the abduction of Shasta and Dylan when the state case concludes, Peven said.

Shasta Groene will meet with 1st District Judge Fred Gibler on Thursday in a closed session to determine if she is competent to testify because of her age, and also whether she will be given special considerations such as not having to look directly at Duncan, or having a comforting person sit near her.

At the time of his arrest last year, Duncan was on the run from a molestation charge in Minnesota. Duncan has also been implicated in the deaths of two children in the Seattle area and one child in Southern California.

"He'll talk about anything they ask him," Peven said, but added that he did not believe Duncan was involved in the slaying of any other children.

The letter said that in exchange for a sentence of life in prison without possibility of parole, Duncan would:

-Plead guilty to three counts of first-degree murder and three counts of first-degree kidnapping in the slayings by hammer blows of Brenda Groene, her fiance, Mark McKenzie; and Groene's 13-year-old son, Slade, in May 2005.

-Will cooperate fully with law enforcement officers on the state charges and the anticipated federal charges in the kidnapping of the children and the slaying of Dylan.

-Give law enforcement officers the keys to his encrypted computer files. A computer expert and prolific blogger, Duncan has bragged that officers won't be able to crack into his computer files for 30 years. The files are thought to contain extensive details of his criminal activities, including still and video pictures of his actions against the Groene children.

The encryption keys would only be supplied if Shasta Groene's legal guardian agrees that the material can be viewed by others or entered into court proceedings, the letter said.

-Family members of the victims who testify during the sentencing phase against Duncan would not be cross-examined by defense lawyers.

"Mr. Duncan is fully aware that this in no way binds the United States in its prosecution of him for any charges it may bring," the letter said.

Idaho has not executed a prisoner since 1976, except for one man who volunteered to be put to death, Peven said.

He also said the federal appeals process in a death penalty case is much faster than the state process.

Duncan Trial Starts October 16, 2006

The trial of notorious child killer Joseph Edward Duncan III will begin with jury selection October 16 for the alledged murders of Mark McKenzie, Brenda Groene and 13 year old Slade Groene. This blog author will be attending the trial and making daily updates tothis blog. There will be a federal trial concerning the kidnappings and subsequent murder of Dylan Groene scheduled after the Idaho trial ends.

In other news, Steve Groene, father of Slade, Dylan and Shasta Groene is recupping in a Seattle hospital from his third surgery on his throat to remove the final bits of cancer.

"We have had several conversations and he is doing fine, and learning how to use his new microphone," said Wendy Price, Groene's sister.

There is a Seattle news conference scheduled for Monday regarding Groene's condition.

The media has been like sharks going so far as to use Price's name to get in closer to take pictures of Groene while he lie in ICU. One female reporter posing as Price got caught in ICU readying her camara to click photos of Groene's neck as he lay asleep recovering from surgery.

Price opined, "Don't try and pretend to be me unless you have walked a mile in my shoes! It's been a hell of a year for me! I would gladly give up being me after the trauma I have suffered."

Stay tuned for more information on the upcoming trial. The judge has made it very clear to the defense counsel that no more continuances will be allowed.

Efforts grow to keep tabs on sex offenders

HOUSTON – Hundreds of cities and 15 states have laws that restrict where sex offenders can live. Now, private businesses are getting into the act of protecting residents from this group, too.
A Texas developer, for instance, is building "sex offender free subdivisions" here and in Kansas, and a new national website, started by a Texan, lists homes for sale that have no registered sex offenders living within a half-mile radius.

It's all part of a wide-ranging effort to address Americans' concerns about sex offenders living next door.

Just Thursday, President Bush signed into law what child advocates are calling the most sweeping sex-offender legislation in 25 years: the Adam Walsh Child Protection and Safety Act, named for the murdered son of "America's Most Wanted" host, John Walsh.

By creating a national database that links the already federally mandated state registries, the new law - among other things - will make it harder for sex offenders to take advantage of varying state laws to avoid detection. It creates a new federal felony charge, punishable by 10 years in prison for failing to update their contact information, and categorizes them by tiers so that resources can be targeted at the most dangerous offenders, says Ernie Allen, president of the National Center for Missing & Exploited Children, which pushed the measure.

More than 563,000 people in the US have been convicted of sexual offenses - and 100,000 are noncompliant, meaning they have failed to keep up with registry laws, says Mr. Allen. "That is just not acceptable," he adds. "Those who won't even comply with the simple minimum requirements of identifying where they are and what they're doing pose the greatest risks. This legislation is aimed at training the nation's resources on that group."

However, his organization is not "wildly enthusiastic" about laws that restrict where sex offenders can live.

One such ordinance was passed earlier this month in Humble, Texas, north of Houston, and punishes sex offenders for living within 1,000 feet of a school or day-care facility by fining them $2,000 a day until they move.

South of Houston, so many municipalities have passed similar ordinances that surrounding communities worry that if they don't follow suit, they will become dumping grounds for sex offenders.

"The key is to know where they are and what they're doing, not to limit where they can live. Because, by doing so, you may be inadvertently pushing them into a situation where we no longer know where they are," says Allen.

Others say databases that track convicted sex offenders and ordinances that restrict where they can live miss the point. "My concern is the misdirection by public officials and parents toward strangers and away from the real threat: the family and friends they know," says John LaFond, author of "Protecting Society from Sexually Dangerous Offenders: Law, Justice, and Therapy."

Studies show that almost 80 percent of sexual-crime victims know their perpetrators, says Mr. LaFond. "These new monitoring laws are symbolic gestures by politicians to show that they are doing something. But in the long run, they do a disservice to the community."

Buying a home that is somehow "free" from sex offenders - whether in a subdivision or a neighborhood that has been screened - is a marketing ploy that feeds on uninformed fears, he adds.

But that has not stopped Texas-based I&S Investment Group from selling out all 150 lots in its "sex offender free subdivision" in Lubbock, Texas.

It is also breaking ground on a similar subdivision outside Kansas City, Kan., in August, with plans for more elsewhere.

The subdivisions' rules will ban sex offenders from moving in, and if residents become sex offenders while inside, they will be fined $1,500 a day until they move.

Taylor Goodman of Dallas in June launched BlockWatcher.com, a website listing homes for sale across the country that have no sex offender living within a half-mile radius. "It's a pretty hard accomplishment," says Mr. Goodman, adding that only about 20 percent of all homes for sale qualify. "This issue knows no bounds. There was an $18 million home for sale in San Francisco that did not qualify."

He also says about 90 percent of the realtors he talks to are not happy about the new website. Studies show that property values can decline if a sex offender moves into the neighborhood.

This spring two Columbia University economists studied data in communities around Charlotte, N.C., and found that a home's value fell 4 percent when a registered sex offender moved in within a 1/10-mile radius. That added up to a loss of $4,500 to $5,000 per home and $59.5 million for the entire county, says Leigh Linden, who worked on the study.

The two concluded that people may go to great lengths to avoid living near a sex offender. "This is definitely more than politicians trying to outdo each other by being tough on crime," says Dr. Linden. "People really care about these things."

        To run an actual campaign on around $10,000 (which is what we did) is a huge deal, not to mention REAL CHEAP! The average Initiative campaign costs well over $500,000 and that is just for the signatures. That does not include postage, materials, printing, advertising… The list could go on.

        What we accomplished is something to be admired and proud of. Thank you all for the countless acts and hours of Good Samaritan work with Dylan’s Law. Our fight is not over and we hope that you will continue to support and help Citizens For A One Strike Law.

The Predator Industrial Complex Wins Again!

Dear Dylan's Law Supporters,

As you have probably already heard from the extensive media coverage we have gotten around the state we collected 203,000 signatures as of the deadline on Friday!

Because of your dedication we made such a major impact that we received out first email from a scared sex predator or at least a pro-perp letting me know his displeasure with our efforts.

I want to thank each and every one of you for your many man hours of collecting signatures, donating money, and your continued support. Some of you are very upset right now and your heart is broken, but please understand that sometimes BIG issues like this one take time to work out and for this issue we have to keeping working it out.

What do we do from here? We keep fighting. I'll tell you the same thing that I told some Spokane supporters on Friday night at a group gathering: We as a culture have allowed evil to take dominion over us instead of us taking dominion over evil.

We can not understand evil like some of our pro-predators would like us to do. We can not rehabilitate evil like those who make a living in the predator industrial complex want to convince us to believe is possible--NO! We must take dominion over this evil! Evil by its very nature can not be rehabilitated and it must be controlled otherwise it runs wild and controls us. That is exactly why we are now facing an epidemic of sexual terrorism. This means we must continue this battle until we have pushed evil back into the pit is so rightfully belongs!

We came close--very close. Eastern Washington media and its Citizens stepped up to the plate and supported this organization and the fruit was that 85% of the signatures came from Eastern Washington. Western Washington media barely cared we existed which was their choice. The result of their insensitivity to this important news story is that Western Wa. Citizens hadn't heard of us thus they didn't sign the petition. The voters of this state had a right to know about this too!

What happened to the Groene family is unprecedented in American history. The FBI went so far as to say that what that animal did opened a new chapter in their text books because they had never seen a sexual predator kill an entire family just to go after the children. This information everyone needs to know, yet Western Washington media continues to ignore this obvious fact. What happened to the Groene family will happen to other families--guaranteed! Will you be the next victim?

Why do I believe this? Because this evil has been let loose and its natural inclination is to do evil against the innocent.

It is our responsibility to rid this country of this plague and NOT WAVER for one second. One state at a time! I am standing my ground against this war on innocent people, and I am standing my ground against ALL compromise in this issue.

I do not and never will believe that giving a second chance to violent sexual predators will curb the unsatisfied desire they posses to commit sexual terrorism on innocent human life thus second chances will not cut down on violent sexual crimes!

We are a no compromise team and we remain stedfast to fight against the predator industrial complex profiting off the lives of the innocent. Please do not give up on us or this issue.

We need your continued support.

The Groenes have asked for us to expand our efforts in the state of Idaho so we will do that. We need you to help us with this effort. We are looking for people with all kinds of skills to lend a hand. I will be sending out an email later explaining our plan in this state.

Dear Fellow Concerned Washington State PARENTS and GRANDPARENTS:

If you haven't ordered your petitions then now is the time to do so! We must get DYLAN’S LAW on our Washington State November Ballot.

Named after Dylan Groene, the molested, then murdered little brother of Shasta Groene whose entire household was murdered during their abduction by the multiple repeat sexual offender Joseph Duncan, who shortly after his arrest with Shasta confessed to killing many additional children during his time in the Seattle area as well (remember the two young Hispanic sisters who “disappeared” from Aurora avenue about 10 years ago, etc?)

He went on to tell police that when the truth about him finally comes out, “then I will be considered one of the worst serial killers in American history”, and all of his victims were innocent children. As Oprah said “ENOUGH, ENOUGH, ENOUGH!” It’s a shame that so many innocent children had to be tortured and murdered before WE THE PEOPLE had to rise up and demand this action, as it’s obvious that we can’t count on our liberal Legislators and Judges to do it, as they “just don’t get it”. Thank God for our right to petition!

I believe it was Gandhi who said: “You can judge the morality of a society by how it treats its’ most vulnerable members”. A society that won’t protect it’s own children is doomed.

We need 225,000 signatures by July 7th to bring this CRITICALLY IMPORTANT LEGISTLATION to a vote of the good people of Washington State, and we currently have only 100,000 as of Sunday May 17th, and MOST of those signatures were from Spokane County alone. Shasta’s Father hopes that this law, when passed, will become the example for ALL the other 49 States to adopt and follow. How could anyone argue with that?

Biker's Ride Out for Dylan's Law a Phenomenal Success!

Tracy,

I certainly don't expect you to remember me from the mass of folks at yesterday's ride but I was the pony-tailed fella trying to give you directions in the parking lot after leaving the last Aztecas.

At any rate, I just wanted to say a very sincere thank you to you and your husband. What you are doing is incredible and even if 921 doesn't make the ballot, you will have done a great service to your community. Someone has to start the ball rolling and you have done that. As a father, citizen, ex-cop, and simply a human being I thank you and extend my deepest admiration.

It seems every week there is an adivisory alerting us to a new Level III offender with a high risk to re-offend moving into our communities. Just this past Friday, the day before the ride, a man groped a little girl just outside the school that my youngest daughter and my grand-niece attend. News story

It sickens and saddens me that our so-called political "leaders" have to be forced into action. But it heartens me to see folks like you and those who have lent so much support take the bull by the horns and work with the system for all of our benefit.

It was an honor to meet you and your husband.

I don't know how many signatures we collected but regardless of the number, I feel as though the event was an amazing success. It generated publicity in the local media but more, it was a highly impactful visual display for Washingtonians. They won't soon forget the long parade of bikers rumbling down Division Street hoisting signs for Dylan's Law!

I intend to contact Sheri and extend the same thanks and appreciation to her. And I also intend to contact Azteca and the Spokane PD for their support.

I've attached a few pictures. I have more if you'd like but just picked these out of the bunch. I attended the event with my brother in law and sister (who you'll see in the pictures). I've never seen my sister so motivated and passionate about a cause before. It was great!

The Blvd will be holding a very special concert, Thursday May 4, 8pm. “Citizens for a One Strike Law” (CFAOSL) “Dylan’s Law benefit show” is a celebration for WA. state to unite in support of Dylan’s Law/I-921 in memory of Dylan Groene an 8-year old boy, and his family who were allegedly brutally murdered, and raped by, Joseph Duncan III, a Washington state parolee.

“I think when more people know about Dylan's Law, the more we'll see an angry uprising of the community wanting to know, why wouldn't we want a One Strike Law to protect the rights of our children? That is my hope,“ stated Chelsey Fanara Whitman county area coordinator.

Joseph Duncan III a Wa. state parolee and convicted sex offender is awaiting trial in Idaho for the murder of Dylan's Groene’s mother, her boyfriend, and Dylan's 13-year-old brother, Slade. Duncan will be facing a federal trial for the charge of kidnapping, sexual assault, the murder of Dylan, and other charges for Shasta, Dylan's younger sister. Duncan will also be facing additional charges in the kidnappings and murders of three other missing and murdered children in California and Washington State. Duncan is also a suspect in other western states.

With Dylan's Law mindless criminals such as Duncan don’t get a second chance. It is a mandatory life sentence without the possibility of parole for violent and predatory sexual crimes such as kidnapping, rape and molestation. The new law would forever protect against tragedies like the Groene families and searched for an answer for years. The answer to protecting the families and, communities of Washington State is Dylan’s Law. It would make it a priority that could eventually lead to the ultimate goal of a national law to protect America’s children. The law addresses the constitutional issues of sex predators' rights and saves taxpayers money.

The Blvd, a twenty-one and older club will be charging five dollars at the door.
The club is directly across from the Spokane Oprah House. Signatures from WA state voters will be collected through the duration of the show in support of “Dylan’s Law.” The bands that will be entertaining are to be announced, and the evening looks to be a very enjoyable one not to be missed.

Yard Sales Were a Success! Unusual Events Comin' Up!

Citizens for a One Strike Law Area Coordinators hosted six yard sales from Spokane to Kirkland raising money so as to reach the goal of $50,000 to hire a paid signature gathering company.

We raised just under $5000. with a few high ticket items still left to sell on Craig's List or Ebay. However, we did get several new volunteers, handed out hundreds more petitions and received tons of media coverage all over the state which brought in even more voluteers. Thank you everyone who donated items, set up and helped with the yard sales and volunteered to collect signatures.

We are very pleased with this effort and encourge anyone who is willing to donate time, effort and money to do so now as we are running up against the July 7th deadline.

There are many events scheduled that I would like to mention to drum up help for Dylan's Law. Here are two very important events. May 4th "Dylan's Law Benefit Concert" in Spokane and May 6th "Ride out to Support Dylan's Law also in Spokane." Even though you may not live in Spokane, please read as this will bless you!

May 6: Sheri Herberholz of Cruiser's Bar in Stateline, Idaho is hosting a "Ride out to Support Dylan's Law" starting at 12:00 Noon. Cruisers Bar has the unique feature of a true to life road running right through the bar and sees about 500 bikers driving through the bar on a daily basis.

Herberholz has organized this event and biker dudes and chicks will start from Cruisers Bar at 6105 W. Seltice Road in Stateline Idaho. (Exit 299) http://www.mapquest.com and drive to the first location at:

Spokane Valley Mall at Azteca (12:30 to 1). They will proceed to the
downtown Spokane Azteca (1:30 to 2) and then drive to the

Puget Sound may have a Serial Killer on the loose!

Unfortunately, yesterday the news was that the partial skull and partial spine found in Lakewood was that of ten year old Adre' Anna Jackson who turned up missing December 2, 2005 as she walked to school.

I found it interesting that the type of location where her remains were found was eerily similar to the type of location where Nicole Pietz, the Lynnwood woman who turned up missing January 28, 2006 was found.

They both were discovered in blackberry bushes right on a road where anybody driving or walking by could see them.

Dumping bodies on the side of a road where any one can see seems very arrogant and overly confident of a killer which makes me believe this is a serial killer.

Now this in and of itself is probably not too much evidence, but that facts are that both females just disappeared off the face of the earth in broad day light with no struggle, no evidence, no nothing and no one saw it happen! This tells me the murderer is accomplished at what he does.

They were both found in blackberry bushes. Nicole's body was found in Green River Killer territory (Burien), and the homicide case of Adre' Anna has brought in the Green River Killer Task Force.

The Police aren't saying whether Nicole was sexually assaulted from the reports I have read, but she was strangled. We will never know in the case of Adre' Anna unless they have found the bone in the neck that is crushed due to strangling.

Are these two cases connected? I don't know. I am going on speculation right now BUT I would live like we have a serial killer out on the loose stalking and driving up and down the I-5 corridor until we find out otherwise.

Be safe, be wise, keep your car doors locked at all times, and do not talk to any strangers!

5000 Signatures Collected at the Northwest Womans Show!

"Let the punishment fit the crime!" (and then some) was the overwhelming response of the wonderful supporters of Dylan's Law at the Northwest Women's Show March 24-25. Citizens for a One Strike Law had a goal and that goal was more than achieved with every person who stopped, signed, asked questions and voiced their support at our booth. The community more than proved that we want to make a difference and change the law to end sexual terrorism against the innocent and helpless in Washington State.

The amount of supporters gathering to sign and the eagerness of some was often a sight to see! We laughed at the comments of what to do with the predators, we cried with victims who shared their own terrible stories and we witnessed so many who left with tears in remembrance of Dylan and Slade. To ease some of the pain, we bragged that Shasta had received straight A's on her report card and that she is doing better than could be expected. People were touched by our efforts and hard work. Many left with blank petitions, determined to have their church members, neighbors and family members fill them up. They believe in making a difference.

Wendy Price, Dylan, Slade and Shasta Groene's Aunt painstakingly worked many hours in spite of a nagging foot injury, bless you Wendy! We want to thank her for being there and sharing her gift of stories with those who wanted to know more about the Groene family children. This connects us to those children, Brenda and Mark who are always in our hearts, prayers and future hopes of Dylan's Law coming to fruition in November.

Thank you to all who signed, to those who left determined to rid our communities and neighborhoods sexual predators and to the efforts of the volunteers of Citizens for One Strike. Everyone made a difference. Especially you, Tracy, you rock and roll girl! Way to go everyone, you are all an inspiration. Now let's keep those petitions coming back, signed completely and in our hands as soon as possible.

One Less Horror for "Imahologram's" Life

Some weeks ago OSL received an email from a third party about the "Dylan Groene Angel Memorial Fund". This email notice appeared to be a generic appeal circulated as a chain email to interested parties. In good faith, because OSL thought the Memorial was a good idea, we posted the text and images as a page on the OSL web site. Now, someone writing as "Imahologram" has flamed OSL and Tracy Oetting as "plagiarist" of the purportedly original message.

OSL had no intention of posting other's material without attribution, assuming the third party email was a generic appeal for a worthwhile cause.

We have removed the content from OSL, and now link over to a "letter to the editor" about the Memorial fund. We hope this will lessen the horror show that is "Imahologram's" life.

OSL still thinks the "Dylan Groene Angel Memorial Fund" is worth your attention, wherever you may find the notice.

Tracy's thoughts about the flame attack

The world of technology has brought on emails, websites, chat boards, and blogs, but what the world of technology hasn't brought with these tools to some folks out there are the rules of netiquette, common sense, civility, and a mature self image.

Some people who choose to use these tools, use this opportunity to fight wars of personal destruction without being adult enough to use their own names! I have always been mystified that if you have the guts enough to annihilate someone's character, or peer into the unknown parts of another's heart and intention then have the guts enough to use your own name!

Realize I sent her a comment for her post letting her know that I was very sorry that we placed the memorial fund notice on our website. We did so because a concerned citizen sent us the notice and we put the notice on the front page at the top of the website AS IS because we believe it was an important project. I said that we never even considered the thought that it would be a plagiarized link, and let her know that we will promptly remove the link.

It was an unwitting error on our part to place this link on our website which we did in good faith. It is unfortunate that IMAHOLOGRAM decided to just blast me with accusations of plagiarism, theft, and emotional manipulation instead of simply emailing me asking me to correct the contents of the link. We would have promptly fixed the problem. It's too bad that the failure of communicating like an adult would cause the removal of such an important project from our equally important website.

Snohomish Prosecutor and Candidate Janice Ellis Runs Interference for Predator Industrial Complex!

Today I received a defensive call from the Snohomish County Prosecutor's office. The secretary informed me that Snohomish County Prosecutor and CANDIDATE Janice Ellis is demanding a face-to-face discussion with me and she'd be willing to meet me in Monroe. Excuse me? You're demanding a meeting with me? The reason? She wants me to explain to her what the "Family & Friends Discount" means mentioned in letters to the editor published around the state! See blog post below.

She stated, "Ms. Ellis wants to understand you." I think she wants to challenge me not understand me. Does she want to understand me the way she understands predators and pedophiles?

I reminded her that Ms. Ellis already understands what the family and friends discount is as she completely supports it, and backed up her position in a piece that she wrote blasting a one strike law for predators who attack innocent people. (See link in title)

I told the woman to call me on my landline to discuss further what Ms. Ellis' demands were and gave her my number. She said she would call but she never did. Things that make you go Hmmm. She calls me, demands a meeting, and then quietly backs out!

Is she afraid of the truth? Is she afraid that there are people who understand that her arguments against predators and pedophiles being locked away for life are deficient? Are you afraid that your upcoming election might be threatened?

Ms. Ellis, on the tax-payer's dime, you have publicly come out against putting pedophiles and predators in prison for life, and you refuse to explain yourself in true logical form.

Your bogus argument that kids won't testify against their daddy if they knew there was an one strike law doesn't hold up to logic. You put people who are dads in prison every day! You don't seem to mind putting those bread winners in prison!

I am surprised that someone who went to law school who is suppose to be trained in the art of logic uses this false argument as their support system.

The bottom line is this Ms. Ellis: You believe and support the recycling of violent sex predators especially when they have chlidren of their own. This keeps you in business, and it keeps these pedophiles in a continual supply of articulately groomed and quiet kids! You are running for office again and you want to appear on the surface that you are tough on crime when really you are tough on the taxpayers and light on the pedophiles and predators.

Tough Law? Feel Safe Yet?

Yesterday, Gov. Gregoire stood up and stated that Washington state has the toughest laws in the country! Is she kidding? What a joke! Let's take five minutes and examine this new law and you decide if this law toughens up the current system.

The bill she signed into law that calls for a mandatory minimum of 25 years for the raping, molesting and sodomizing of children doesn't cover 90% of the violent sex crimes against those kids!

We call this bill the "symbolism over substance" bill which includes the "Family and Friends" discount. In other words, if the perp attacks a child they know they get the F&F Discount. This "tough" law was only passed because of the upcoming elections. A lot of prideful back slapping going on around here!

Basically the new law states that if you sexually violate a child you get a MM of 25 years BUT if you also kidnap that same kid you don't get any increase in sentencing. If the perp happens to know the victim then this law doesn't even apply to them.

Since 90% of most violent sex crimes happens to people who are known to the perp they get the "Family and Friends" discount of six months, a slap on the hand, and forced treatment, so that they can get out and do it all over again. This is the back bone of the jobs creation program for this predator industrial complex.

This horrid law basically sets in stone Special Sex Offender Sentencing Alternative--SSOSA--for the "Family and Friends" discount. Be aware this won't change a thing in the Predator Industrial Complex.

Time off for good behavior and work release is still part of this package.

This is a tough law? I think not! A tough law sends a message that ALL children have value and deserve to be protected from ANY one who sexually violates them even if that person is called dad, grandpa, uncle or brother. Pedophiles have children too! And what better way to have a continual supply of victims than to have their own children groomed to keep their mouths shut!

The governor just signed into law a bill that sets in stone the protection of these very kind of pedophiles!

What is wrong with these legislators that play around with sentencing laws for sex crimes, and the future of these kids thus the future of this state and country?

Dylan's Law sends a message to ALL sexual violators that one strike is all ya get! Our children have value and Dylan's Law offers a true solution that MAKES people safe not just makes you FEEEEEL like your safe.

I-921 offers no compromise when it comes to punishing violent sex predators. These types of offenders do not deserve second chances--these kids do!

Thanks for collecting or supporting Dylan's Law that doesn't give special rights to those pedophiles who hide behind the name Family!

Groenes pressured not to testify

Victims' relatives want death penalty, no deals, for Duncan

COEUR D'ALENE, Idaho (AP) - Family members of victims say they don't want the state to make a deal with Joseph Duncan III that would let him avoid the death penalty, even though a trial could be difficult for lone survivor Shasta Groene.

Duncan's public defender, John Adams, said last week a plea agreement would be easier on Shasta because she wouldn't have to testify at trial, but could only be made if the state didn't seek the death penalty against Duncan.

Duncan, 42, of Fargo, N.D., has pleaded not guilty to three counts of first-degree murder and three counts of first-degree kidnapping in the slayings of three people in their Coeur d'Alene-area home in May 2005. Killed were Brenda Kay Groene, 40; her son, Slade Vincent Groene, 13; and Mark Edward McKenzie, 37.

Federal prosecutors say that when the state case is resolved, federal charges will be filed in the abduction of 9-year-old Dylan Groene and 8-year-old Shasta Groene from the blood-drenched family home, and Dylan's subsequent death at a Montana campsite.

"For anybody to think we'd want to plea-bargain with him, they're totally crazy," Mark Doble, husband of Brenda Groene's younger sister, Sandra, told The Spokesman-Review of Spokane, Wash. "This guy ruined our lives. He needs to pay."

Of his niece, Shasta, he said: "She's very strong. She will be able to testify. It needs to be done."

Adams hinted last week that a plea agreement could be possible, following a hearing in which 1st District Judge Fred Gibler postponed the trial six months at Adams' request.

Shasta's court advocate, and her father, Steve Groene, accompanied by his attorney, testified in closed proceedings in the judgeâ€'s chambers. Adams called Steve Groene as a defense witness during the hearing.

Afterward, Adams said a plea agreement would be easier on Shasta.

But Kootenai County Prosecutor Bill Douglas said there will be no negotiations, and family members say they back that decision.

"We're definitely not interested in any plea bargain whatsoever," said Darlene Torres, Brenda Groene's mother. "Mr. Douglas, we're behind him all the way."

Steve Groene, father of Slade, Dylan and Shasta, has not said publicly whether he prefers a plea agreement or a trial.

The brother of Mark McKenzie, Steve McKenzie, said he understood the concern over the idea of Shasta being called to testify. But he said the death penalty should not be bargained away.

"That was my dad's son and my brother," Steve McKenzie said. "And he was tied up and beat to death with a hammer. We don't want to plea bargain with this guy."

Had there been a One Strike Law, I wouldn't have waited so long to tell!

There has been a great deal of talk about whether victims would come forward to report sexual abuse if their abuser was a family member, and if they were aware that a One Strike Law was on the books to send the offender away forever. I can't answer that for anyone other than myself.

I was sexually abused as a child by a relative. To really explain it to anyone is difficult, because the story really began before the abuse I experienced did. So, please bare with me.

If you would have heard them talk about us back then and not known who was who- you could have easily mistaken me as the older sister- despite the fact that she was really 3 years older. That's because sometime when I was four, my sister lost her courage. Well, at least I thought she did. The frail, slender 7 year old girl who had always been outspoken just seemed to lose her voice one day, and it only seemed right in my little mind to "find it" for her. So I began to be her voice, defending her with all my might, standing by her at every turn, and protecting her as only a sister could. We lived that way for years, with her always backing away from her problems, and me always solving them. Despite the order of our births, I became the "big" sister, watching out for the one who couldn't seem to protect herself.

What I didn't know then, was that she hadn't lost anything. But rather, something was happening. And every bit of strength she had, every bit of courage, and bravery she could muster up, was being used to deal with it.

He told her no one would believe her, that even if she told, nothing would change, and that worked for a time. When he began to worry that she'd see through his threats- he upped the stakes. Demanding her silence, he told her the only way to keep him from hurting me, was for her to never tell about the abuse she was suffering. The very one I had grown to believe was weak and helpless, was courageously living with her secret- to protect me.

She didn't know he had lied, that by the time I was seven he was no longer fulfilled with just molesting her- he had begun molesting me too! Of course, my silence was easy to secure- after years of believing it was up to me to protect her, I wasn't about to betray her when it meant the very most.

It would be four years of dealing with the consequences of my sisters abuse before I would finally gain my own strength, my own voice. And when I did, I had a choice to make- do I press charges or do I find my own way to deal with it?

This is where the laws come into play. Back then, (and even now) Ohio didn't have laws that had any significant consequences at all. But, we didn't know what the laws where- and so with my sister informing law enforcement, and with the help of many investigators, and the prosecutor- charges where brought against him for the sexual abuse of my sister.

I must tell you, after pretrial, court dates, and affidavits, he received just a few months in jail. He may have gotten a bit more time, but there seemed to be problems with the reports that were filed with law enforcement. Some instances happened within city limits, some within the county. Those in the county were the more serious of crimes, and they just happened to be the reports that went missing for seven long years. Whether it was because for a time he was well known and respected with the county sheriff's office, or if it really was a simple mistake, we'll never fully understand.

He was convicted, and sent to jail for that short amount of time, and then released. He was free to harass and terrify my sister, and my family. In those four extra years of my silence, I watched as she fell apart. The nightmares that he would come after her, the trips to the hospital, the suicide attempts, how she was suddenly afraid to be alone- it was horrifying to watch her suffer through it. Almost daily, I felt compelled to speak up, but one look at her, and I couldn't imagine having to tell her she suffered all those years thinking she was protecting me, for nothing. So, instead, I learned to bandage up the cuts on her arms, to help her hide them so they wouldn't send her away again. I continued to protect her, not because I still thought she was helpless- but because now I felt I owed it to her. Her pain didn't end with her telling, and everyday knowing he was free created more fear and anguish for her.

One day, for no reason other than I could no longer remain quite- I blurted out what he had done. In that one moment- every detail from the first time to the last poured from me. And so it was that I found myself sitting in the police station soon after that "dreaded moment", explaining to a police officer just what happened, and why it was that I had spent so long trying so hard to not tell. The officer asked to be alone with me for a moment- and as the door shut behind my parents- he asked what I wanted to do.

I think that was the last thing I expected someone to ask me. What I wanted? See, I thought I didn't have a choice, I thought that I would have to endure what my sister had- testifying. I didn't want to testify. Because, even at 14 I wasn't so sure that he wouldn't come after me. After all, I'd spent years watching him harass my sister. I remembered the day he tried to run her down with a car- and the fact that no one did anything.

By then (that day I told) my sister was getting better. She wasn't having as much trouble sleeping, she was almost laughing like she used to again. The rest of my family was recovering well too, well as much as could be expected. So, there I was- on one hand I wanted him to pay, on the other hand I already had a pretty good realization of just what his punishment was likely to be.

To this day, I doubt he even knows that I told. I didn't press charges against him. Strange, huh? But, to me it was because I knew I was safer NOT doing it. IF I had, his anger would have flared up again, as would the harassment and the threats, the phone calls and the rest of it. And, I couldn't live through that again. Sending him away for 60 days wasn't enough to justify going through all of that once again.

Had there been a One Strike Law, and had I known about it- I wouldn't have waited so long to tell. I wouldn't have had to fear that he would be free to go through with the threats he had made. I would have been safe, and more importantly so would my sister. The years we lived in constant fear would have never happened, because he would have been sitting in jail rather than sitting across the street every time we walked outside. After a few very long years, he moved on, I don't know if his anger that she told subsided- or if he just outgrew the need to terrorize us, but never have I doubted that had I made the choice to press charges- the torment would have lasted much longer.

In the end, I don't think he bought my silence by the terror he put us through, as much as the system ensured it by failing to give my sister justice, and failing to offer it to me. So, that's why I support the One Strike Law, Dylan's Law. Because from my point of view- more victims would be willing to tell and have family prosecuted if they knew that after they did- they would be protected by knowing that the abuser was going to be locked up for the rest of their lives.

I am sorry for your your trauma and I am as angry as you are about this injustice! I would like to ask you a question:

According to some Prosecutors, and a lot of bureaucraps who make their living off of the sex offender trade, are vehemently opposed to a one strike law because they say (and we all know how right and wonderful bureaucraps are) victims who have been raped, molested or sodomized by a predator family member won't testify against the predator family member if the victim knows there is a one strike law w/o parole hanging over their predator family member (See articles below).

Would you have testified against your predator family member knowing that they had a one strike law w/o parole hanging over their head?

Focus Like A Laser Beam

Last night’s meeting in Burien went very well. We had several new volunteers, the press was there and most importantly a big lot of the Groene family was there to support CFAOSL and our staff despite some people’s attempt to say that I am doing this for the publicity! What publicity we can get!

I want to say thank you to the Groene’s for their support and love towards all of us and I am so glad to have met the nicest bunch of people in a long time.

The meeting was basically an organizational meeting and talking about what crimes are under Dylan’s law. We talked about how when this law is passed it will force Oregon and Idaho to pass their own laws and how this will create a wildfire across this country.

Currently, there are attempts to pass other kinds of sentencing laws re: sex offenses, but these laws will only create second chances for sex predators. We are vehemently opposed to giving second chances to violent sex predators. They do not deserve a second chance, our children do!

When one examines the high profile cases in every case, but one (Elizabeth Smart--correct me if I’m wrong), all of these predators did a least 20 years. Most did more, but not all at the same time. The argument is that we are knee-jerk reactors, but reality is that each one of these high profile cases represents thousands of missing, raped, molested, sodomized and murdered children that never get ANY media attention--not even local media attention! Our efforts are not knee-jerk reactions; they are sound common sense activism that should be going on in every state in this country! I suspect eventually OSL will be the topic of discussion everywhere as the only solution that makes sense.

We are going to focus like a laser beam on getting the Groene bill passed in Washington state. That is our focus. Our focus will not shift from the left or to the right and our focus will not be to placate to people who want to play around with sentencing laws by giving second chances to the sex predator instead of the children of this state.

CFAOSL’s focus will not be to say we are doing it for the kids--we really will do it for the kids. We won’t buckle under when the gub’ment says we are liars and we will damage kids by passing a one strike law. We won’t believe the lie that kids won’t testify if they knew there was a one strike law. It’s really about the money folks! How would a kid know what sentencing law there was unless they were told by some “groomer” be it the pedophile or the government groomers as a threat to their life?

Ban child victim testimony in sex abuse cases!

A mandatory minimum bill for 25 years for first degree child rape has just passed the Washington house and senate, and the governor is expected to sign it. However, it includes such a large exception and loophole that Schwarzenegger's hummer could drive though it. The 25 year minimum excludes any convict where the sex convict is known to the victim. This law and its exception were featured on O'’Reilly Factor and Bill was scratching his head about this exception, as many of us are.

The rationalization behind this exception is that the child victim would never testify against his family member if the victim was informed that his testimony would cause his abuser to receive a very long or life sentence. Tracy has written an excellent post on this blog, analyzing a likely scenario where this situation would likely occur, and under what circumstances.
Upon examination we find that if the evidence is strong and the prosecutor has been diligent in gathering this evidence, then he would have no need to further burden the child victim by requiring any testimony from him. As Tracy points out. "“If the prosecutors and cops have gathered their evidence and have done their job then they don't need that kid to testify and even if the kid does testify, the testimony will either uphold the evidence or it won't!"

If any case absolutely depends upon such child victim testimony, then either the available evidence is too weak to convict without such testimony, or the prosecutor is lazy and/or incompetent. This is a situation where the accused is most likely to be innocent because there is so little evidence, and the prosecution is tempted to plea bargain to avoid a trial. But without a trial, there is no true justice. It becomes a mere negotiated settlement between the accused and the prosecutor, and completely violates the principle of being presumed innocent until proven guilty. It casts aside both the truth and facts as irrelevant as to whether the accused is innocent or guilty. Either the accused receives too lenient a sentence if he is guilty, or he gets an unjust sentence if he is innocent.

Another grievous miscarriage of justice can and has frequently occurred where the child is coached to testify against an accused person for the purpose of justifying more tax revenue budgeting for Child Protective Services. This situation actually occurred in Wenatchee, Washington in 1992 -1995, also known as the Wenatchee Witch Hunt. There was not a shred of hard evidence to support any of these false allegations against these innocent people, but there was plenty of coerced and manipulated child testimony.

This created one of the most wicked injustices ever perpetrated against innocent defenseless citizens who were unable to fight back against this monster Wenatchee Detective Perez and his CPS accomplices, who should also be put away for a life sentence for their crimes of fraud, extortion, witness tampering, perjury, conspiracy, racketeering, kidnapping, false arrest with no warrant or probable cause, and false imprisonment against the innocent; not to mention several counts of constitutional violations. Their crimes are just as serious as the known false charges that they brought against the innocent, and they should face the same sentence for these false charges that they sought to bring against these innocents. They have yet to face a criminal trial and the appropriate sentence for their crimes.

What I am proposing here is a change in judicial codes and statutes that would ban the use of any child ( age 12 or under ) victim testimony as admissible evidence. What would this do?

1. It would prevent the Wenatchee Witch Hunt scenario from ever happening again.

2. The sex offender bureaucrats, lawyers and detectives could never use or manipulate the child victim as a pawn for testimony, and thus would greatly reduce the frequency of plea bargains, most of which occur solely because of child witness testimony.

3. These same sex offender profiteers could never argue for a "“friends and family discount"” exclusion from any mandatory minimum or life sentence, and it would thereby remove this ridiculous excuse for light sentencing of family members under Special Sex Offender Sentencing Alternatives aka SSOSA. Any given case would more likely either go to trial or be dropped entirely.

4. Another effect of this change is that it would increase support for a one strike law among citizens that are justifiably concerned about false accusations from overzealous prosecutors using coached child witnesses and rushing to judgment. Because of those very real fears many do not support a one strike law, and the elimination of this great source of prosecutorial abuse would assure these citizens of the essential justice and necessary protection of a one strike law, and cause them to support it.

There are probably many other points that could be presented to support this proposal, and there may be some points against it that would need to be considered. Let me know what your thoughts are, and any other questions or scenarios that should be considered regarding this proposal.

I hope that you are not too dismayed to receive letters from me. Normally I would not reply to such a rage filled letters, but I honestly saw genuine pain behind your words and I felt you at least deserved some kind of answer.
You are completely right, "no one has the right to play god", but sadly that is exactly what I was trying to do by condemning society for being "evil and inhuman." But god himself appeared between me and Shasta and commanded me to take her home immediately! So, I did. I don't know why he did not appear to me sooner, you'll have to take that question up with god, (and he can answer, if given a chance.)
But, since I surrendered to the authorities of this world God has been speaking with me everyday. (No, I'm not crazy and I'm not "hearing voices" or anything like that.) I know it is God talking to me though, because not even the devil himself could have made me turn myself over to my most feared and hated enemy ("the system"). It was god God himself who asked me to write you and at least try to let you know that his forgiveness is for everyone! If salvation were only for the righteous (or mostly righteous) then it would not be salvation! There is one simple message that God just asked me to convey to you (apparently he thinks you'll understand): God's power is his forgiveness, if he cant forgive me then he is weak and not God at all! Is that what you really believe?
I realize, of course, that you are hurt and angry, and that was the only reason you said such things to try to hurt me back. And to be honest, it does hurt, more than you know. My own anger, pain and confusion over what happened is more than anyone's (except possibly ! the families, of course). So I know how you probably feel. So, I'm glad that you wrote to me so I could know how you feel. Right now how other people feel is much more important to me than my own feelings.
But, as a society, we need to focus on the future "Dylan's",the ones who also deserve nothing but the best in life, before they too loose it to some hate filled person who wants to "play god" by judging those around him instead of taking responsibility for their own feelings! The question should not be "WHY, WHY?" But rather "how can I help stop this from happening again"?
Jean, I know you are hurt. But killing me will not kill the sickness that is in the world that causes this to happen. You are not really angry at me, you are angry at the sickness that I represent in your mind. But God is glorious and all power full God, and if you have faith in him he will lead you to the understanding ! you need. To see me as a human, and to see the "evil" for what it is too. (And maybe putting it to death, not each other).
If dying, even going to hell, could erase what has happened then I would volunteer in a moment. But it cant, so even though dying at this point in my life would be easier than facing what I have done. I must face it (God says so) to give the world a chance to understand, and hopefully grow, so that the next time a man like myself comes into the world (and there are certainly many already here, just waiting repetitiously for their own anger to surface) then maybe as a society we can reach out to them, exactly as I'm reaching out to you now and say, "I am sorry, please forgive me". Not for my sake, but for all of our sakes, and for the children's sake!"
Our fear and hatred is the sickness and there is no "good hatred." If you continue to hate me, and even kill me, then you send a message to other "s! ex offenders" in this country. I HATE YOU! And I wish you were DEAD! You need to honestly ask yourself how that message will affect them the next time they see a vulnerable person who represents to them exactly what I represent to you!
So, should we just "kill them all?" Jean, look where this is leading. I sense that you are a far better person then that or you wouldn't have even given me a chance to feel your pain and anger by taking time to write.
I hope and pray to God that this letter helps, even if in the smallest way, to alleviate your pain. It is so important to me that people understand Gods presence and power in all that happens. He has a plan for all of us that are literally beyond your imagination, and if you simply obey his greatest command, "to love him" then he will show you his plan too. (You don't ever even need a bible, but it can help.) Just open your heart to God. A good way to start is to o! pen your heart to someone you hate (not necessarily me). We Need Tougher Sex Crimes (Uh,…laws)

When will America learn? It seems nobody remembers the result of “getting tough on alcoholics” (the prohibition). It was literally the birth of organized crime in America. Or what about “getting tough on drugs” (the so called “War on drugs”)? We now have over five times more drugs in this country than before! So now we need to get “tough on sex crimes?” That’s synonymous to saying, “We need more sex crime!” It’s really no mystery why. If you take control away from a person who has an obvious need for control (a “sex offender”—just for example) then what do you think they’ll do? Give up? Not likely. They are going to find a way to take control back, at any cost. And guess what? Do you really think they’ll look for a new way to get control, or resort to the one way they know? Hmm, maybe if common sense doesn’t snap us out of our delusion history will. Since America started getting tough on Sex crime in the mid 80’s we now have more than double the sex crimes per capita than the 70’s. (Get the almanacs out people- it’s all right there!) And a very good friend of mine who happens to be a “serial killer” told me that he committed more sex crimes during the two years he was on parole (including killing three children) than he did in the entire five years he was not on parole. In fact—he tells me that while he was not on parole he committed NO crimes until the police started doing illegal quarterly registration checks at his home (coming to his house to make sure he was complying with the law). He said that was when he started looking for control again—to prove (consciously and subconsciously to himself) that “they” couldn’t control him. So now more people are dead and hurting because some police chief decided to take it upon himself to “get tough on sex crime.” I’ve said it a million times and I’ll say it again, “the only cure for crime is Love. Everything else is just more crime!”

A child won’t testify if they know their family member will get life in prison!

This is probably the most made statement among bureaucrats and agencies/government tax-paid employees I ever hear. But upon closer examination we will unlock the mystery of why those who are sex offender bureaucrats believe what they believe.

Here's a scenario for ya:

A seven year old little girl is being raped, and or molested by her "father." If this person was any other stranger we would call this "father" a pedophile, but in the world of social workers and prosecutors and some cops this "father" is considered a father of the victim-child. This is an important distinction to be made because there are two camps of sexual abusers (1) "Real" pedophiles (according to sex offender bureaucrats) and (2) Family members we can't call pedophiles, but behave like pedophiles--okay back to the scenario.

This "father" figure is molesting, and raping this little kid and all the while he is telling the innocent little child that if she tells anyone SHE will be taken away from her family. Pedophiles are notorious for threatening children with their lies, but we have to remember in bureaucracy terms this pedophile is a father. These threats are part of what'’s called "grooming." Anyway, she has been threatened with foster care. So the little girl has been molested and threatened with expulsion if even the mother of the victim finds out.

She goes to school and all of the kids are playing with dolls, and the little girl starts displaying behavior that is conducive to a child who has been raped or molested. The law demands that the teacher report her suspicions to the "authorities." The "authorities" have nothing but hearsay suspicions, but they proceed further with their investigation, and into the home walk the social workers. They bring the child into a separate room, and set her down and start talking to her like they are at her level. They ask her some questions that have nothing to do with why they are there so as to gain her trust, of course. Really? Do you really think a child who has been groomed by a person called "daddy" is really going to trust strangers? They ask her more questions and through their investigation they determine that the little girl has been molested.

What do the "authorities" do now? They come back to the house with more strangers, and a stuffed animal, and they remove the child INSTEAD of the "father" so everything the "father" has said has now come true. The "father" gets to stay in the house while the investigation goes on and the child is removed from the house and further more in some cases not all the children are removed just the one kid suspected of being abused. I never understood that!

The child is taken to a state doctor who gives the child a pelvic exam where the doctor discovers now that the child has bruising around her genitalia and her hymen is gone. Now, the investigators have physical evidence that "someone" has molested and raped this kid, but who? After a little while of more questioning they decide that it is the "father" and rightly so, the father did do it.

In walk the cops who arrest the father and haul him off to jail to await his due process. The kid is still in foster care so in her world what her "daddy" told her came true. In all of the mistrust and lies he perpetrated against this innocent kid the one truth he told was what would happen to HER if she told, and it did.

The prosecutor gets the evidence and tells the cops, "I have enough evidence to proceed with a trial."

Now the intense investigation starts with both prosecutors and defense attorneys along with child shrinks and counselors taking this kid into a separate room and questioning her. During the questioning process some adult tells the kid that the "father" will go to prison for life if she testifies against her "father."

Who told her this and why? Could this be part of the grooming process, but now is it the system who are the groomers?

"If you tell them they will take you away from your family," explains the pedophile--I mean "father."

"If you testify your 'daddy' will go to prison for life, and you'll never see him again," the defense attorney whispers.

"If you tell, honey, we won't have daddy to take care of us anymore, and I'll have to go to work," cries the mother, "and what will the neighbors think?"

The seven year old feels pressure from all sides to not tell. This is obvious. A concerned citizen steps in to try and make real change re: pedophiles and the crimes they commit by creating a law that says if you get convicted of a heinous sexual crime against a child you will go to prison for life and what do the bureaucrats say to me? The child won't testify if they know the "father" will go to prison for life!

Why would a kid know what the sentencing laws were unless an adult told her? Are we to withhold from creating tough sentencing laws for pedophiles, and let me remind you that fathers who rape, sodomize and molest their children ARE PEDOPHILES, because the kid won'’t testify if she knew there was a life sentence? That is ridiculous and what's even more ridiculous is that some adults who work with these victims believe that crap! They parrot this statement like breathing with out even thinking.

Let me also remind any prosecutor or cop who is reading this that you and many others know that the worse kind of evidence a prosecutor can have is witness testimony for all kinds of reasons which I won't go into here, but you know that that is a fact. So to not support an OSL because you believe that children won't testify on the one hand if they knew there was an OSL, and then proclaim that victim testimony is the worse kind of evidence on the other hand is schizophrenic.

There used to be a time when prosecutors actually found and presented evidence to a jury, the trier of fact, and the jury, actually concluded with their plea of guilty or not guilty. Now-a-days the prosecutors plea bargain everything because it is better to at least get them on something than nothing at all. Is this thinking always true?

This leads to the next dilemma which is a clogged and highly expensive court system because our dysfunctional government system is more interested in saving their jobs than actually being worth keeping around. Gee, think about it: the more offenders of all crimes go through the system the more your position is needed to deal with them.

Our system is full of groomers. Either we have a state filled with pedophile groomers or we have a government system filled with groomers trying to protect their assets instead of doing what's right!

Then when concerned Citizens come along who actually can think this through the government tries grooming the concerned Citizen. Well, you may think that will work with a kid, but it's not going to work for this American and Washington state Citizen!

If the prosecutors and cops have gathered their evidence and have done their job then they don't need that kid to testify and even if the kid does testify the testimony will either uphold the evidence or it won't!

The bottom line: We have bureaucrats involved with a "jobs creation program for the predator industrial complex that was deliberatly created so as to grow govenment and make these bureaucrats feel wanted." The more lenient the sentences are for these crimes the more these bureaucrat jobs are necessary so as to process the pedophiles through.

With a one strike law a pedophile who is convicted for kidnapping, rape, sodomy or molestation gets ONE trial and ONE sentence. Wow! If we actually got an OSL through I guess some bureaucrats might lose their jobs because the system is actually working.

Ya know some of you could actually work in the private sector as attorneys and private detectives and shrinks. You could do it ya know. Why are you so afraid to make a living that depends on you and not on big government and us taxpayers?

She nearly died by the hand of a repeat sex offender!

I would like to share with you my story:

On May 22, 1973 at the age of 5, I along with a 4 year old male friend, was lured away & molested by a previously convicted pedophile while playing in a park. All the while my mother was playing tennis a several yards away with her friend.

Held at knife point and then molested, having forced to perform sexual acts. I was also threatened with my life and my friend's life if I did not do what this person said, or if I made any noise. Finally, after 30 or more torturous minutes, our mothers eventually took notice that we were no longer visible, finished their tennis game & began looking for us.

In my heart, I truly believe that the only thing that spared us our lives was just a few precious minutes. At that point this pedophile had no choice but to release us. You must know that during the attack, for the entire time we could see and hear our mothers. That is how close to us they were.

This, I also believed, truly excited our attacker. As our mothers drew closer James (the pedophile) reluctantly released us, but not before he told me that he knew where I lived, what my name was, and that he would kill me if I told anyone, and that I was lucky because he was just about to kill us.

My attacker, James F. Fisher III, was 16 years old, caught and sentenced to time in a Juvenile Detention Center. This was not the first or last anyone had heard of James Fisher. Fisher had prior molestation offenses that were either thrown out or he was placed on probation for.

At the time of our attack he was on a weekend leave from a juvenile facility. Even though Fisher was known to admit that he fantasized about molesting and killing children; it was even noted and documented by police and the courts that he had hoped to kill me and the other child I was with.

He was quoted as telling the police office that was driving him back to the juvenile facility that he had intended on killing us, and that he planned on killing any future children he was to come into contact with. His very own bedroom was found to be plastered with pictures of tortured people.

Ninteen months later Fisher was released from juvenile hall again to spend another weekend at home. Without the neighbors, or the police’s knowledge he was brought home by his own mother. Immediately, upon returning home Fisher sought out to find another victim. Within hours he lured a young neighbor named Jonathan (5 yrs. old) to his garage and then proceeded to molest, torture, and kill him. Fisher then began looking for a place to hide Jonathan’s body.

When Jonathan’s parents discovered that their son was missing, they notified the police. And the search began. Jonathan’s own father and a neighbor found his son after catching Fisher dragging Jonathan’s limp body by the neck through the bushes in the back yard.

Within hours, my father and I were on a plane flying home from our vacation. The next day I had to identify Fisher in a line up, and then again at the murder trial. I gave testimony and was forced to relive the event over and over again with lawyers, police officials, the judge and therapists. Jonathan's murder never had to happen.

What is more disturbing is that not only could Fisher have been stopped, but that the entire system let down everyone involved with Fisher. He was seeing a therapist in the juvenile facility who also happened to be a previously convicted pedophile, and yet was still able to obtain his therapist license, and eventually was hired by the Juvenile Corrections Department to treat the very same kids who were committing these crimes.

In addition to that, Fisher was going home on weekends with his therapist for what he called "Therapeutic Weekends." He was really having a sexual relationship with his therapist. This therapist eventually lost his license after Jonathan was murdered, but then left the state never to be seen or heard from again. I know he is still out there committing crimes against children, unless he is dead. Nobody knows for sure.

I wish you much success in this quest of yours. I hope that not only will you spare innocent children from being abused, molested, and killed by these monsters, but that you may make the drastic and much needed changes in our legal and judicial system, not only in finding and capturing these pedophiles, but perhaps changing the laws and the way our own government handles these truly sick people.

Dylan's Law has been filed & Your Help is Necessary!

Dear One Strike Supporters,

Citizens for a One Strike Law (CFAOSL) has filed Dylan's Law in honor of Dylan Groene who was sexually brutalized and violently murdered by Joseph Duncan III. Dylan's Law is a mandatory life sentence without the possibility of parole for violent and predatory sexual crimes such as kidnapping, to the vicious rapes and molestations of our young and defenseless children.

People like Joseph Duncan can not ever be let out of prison! Duncan served 17 years of a 20 year sentence and was let out of a Washington state prison were he allegedly left a trial of missing and murdered children from Oak Harbor, Washington to California to North Dakota. He ended his alleged crime spree where he let loose, stalked and murdered Dylan's mother, her boyfriend, Dylan's 13 year old brother, and finally kidnapped Shasta and Dylan where he acted out on them in the most evil of ways finally ending his evil by viciously murdering an innocent eight year old child!

When will we make this stop?

This proposed law makes protecting Washington's children and communities a priority, addresses the constitutional issues of sex predators' rights and saves taxpayers money!

The staff at CFAOSL is seeking your help in promoting this vital cause in this upcoming initiative session. We need to get the word out to our neighbors, churches and civic groups that there is a real solution to this public safety issue. Dear Miss Winfrey,

I've noticed your new action to apprehend sexual predators, at your web site and on your TV show.

Apprehension of sexual predators is only the beginning to protect our children and families. Recidivism is a serious problem with sexual terrorists. Unfortunately, in Washington State, sexual predators are treated more like endangered species than dangerous criminals. Washington State builds "predator palaces" to house violent sexual predators after they serve their criminal sentences at a cost of millions of dollars to taxpayers.

If predators will be released, many will re-offend - the latest outrage was the horrifying story of Shasta Groene whose family was slaughtered after Joseph Duncan was released by the government in Washington State. The Groene family paid with their lives for the failure of Washington State to confine Duncan for the rest of his life. How many more families will pay with their blood?

Citizens of the One Strike Law campaign believe there is only one reliable solution to protect families from violent sexual predators - sentence them to life in prison without parole or release, not expensive taxpayer housing back in the communities they have terrorized.

Did you know that for 2 years citizens in Washington State have been trying to get a One Strike Law ( life imprisonment without parole or release ) for violent sexual predators on the ballot ( initiative to the people )?

Oprah--Thank You!

Finally, someone is making sense. Today on the Oprah show Oprah stood up and said we need to put sexual predators in prison for life after the first time! Yes! That is exactly right! I want you to know that I have been asked to sponsor a mandatory minimum law of 25 years to life after the first conviction of violent sexual crimes.

Let's examine that idea. Joseph Duncan was sentenced to 20 years in Washington state, but only served a meager 12 years. Thanks a lot Washington state DOC (Dept. Of Corrections) for letting out one of the worst child molesters and child murderers in United States history. You owe the Groene family an apology and your representative should beg forgiveness!

Would 25 years have saved the Groene family? No! Even if Duncan had served the entire amount of time Duncan still would have been let out and the Groene family would still have been slaughtered! Precious little Dylan would still have been sodomized and his body burned to ash. Can you image the terror this little gift of God went through?! Can you image if it was your child?

I do not and never will support a mandatory minimum law and I won't compromise my stance just because I think it might help us to take one step back in passing stronger sentencing laws for violent sexual predatory crimes. In other words, I do believe that we can pass this tough law and we don't have to take steps backwards to get there.

This is in response to Carolyn Trueblood ("Why not castrate offenders?" Aug. 16) and all others who believe that castration is the answer to the epidemic of re-offending sexual predators. Castration does not work because the thing that makes a violent sexual predator what he is is not in his genitals. It's in his brain. You can remove their sexual organs, and they will use an object to commit a rape.

The reasons for why they do what they do can be discussed for years to come. What we need to do right now is just put a stop to it. How do we stop it? By putting our values back into the correct order. We have to value the lives of innocent children and women, above the freedom of guilty predators. In other words: stop letting them out of prison. Once they're in prison, let's just keep them there, and they won't be able to re-offend.

Hello everybody. My name is Mike Schuler, and I live in Spokane Washington. All of our lower income neighborhoods are under siege from the constant threat of sexual predators looking for children to abduct. There are 1,308 registered sex offenders in Spokane County. As of today, there were 120 Level III, and 125 Level II sex offenders living here. Imagine this: the second largest city in the State of Washington with a population of about 431,027 (2003 census projection) in the county, being made to live under the rain of terror by 245 freaks that should be in Walla Walla making license plates. But they are not. Some of them are driving around looking for children to abduct, so now you can't let your kid out of your sight for even one minute. It you do, it might be the last time you ever see them. Nice, huh? On Friday evening, I passed out 200 flyers letting people know about the OSL initiative that will be filed in January. People want to sign the petition right now. This is the best news they have heard in a long time.

Since it was Friday evening, I went around town to several different bars to post and pass out flyers and talk to people. Of all of the people I talked to, I only encountered two objectors to the OSL. When I went into Fast Eddy's at Divison St. And Spokane Falls Blvd., I was going to see if the owner was there so I could get permission to tape a couple of flyers to the windows so people could see them. I saw a friend and customer of mine who owns an antique store sitting at a table with two other gentlemen, so I went over. He already knew I was there to pass out flyers, because he had seen them two days earlier. He said "Hey Mike, show it to these guys." I laid a flyer on the table. The first man ready it outloud and then said "It's not the laws that have to change, it's society that has to change. If you want to effect a change on society, you should go on educational T.V., and teach people how to raise their kids." A big giant question mark appeared above my head and I said "Huh?" I pulled out a picture of a 22 year old Level III sex offender that has been through the system 3 different times for sex crimes. At the age of 12, he raped a 6 year old boy. He is roaming free under no supervision. I asked the man "How is going on educational T.V. going to save the life of this freaks next victim?" And the man said "Look, I'm a deputy prosecutor for Spokane County, and my friend here has a wife who is head administrator for the family law court. We deal with this stuff every day. Your OSL is not going to work because it doesn't change society or the way people raise their kids." I said "Are you saying that the fact that you can't let your kid out of sight for a minute now, is because of the way people raise their kids?" I said "I heard about a 13 year old at a park who left her family picnic to go to the bathroom, and they found her the next day raped and murdered. Are you saying it's the parent's fault for not raising her right?" (Inside my head, I had already realized that I was talking to the predator industrial complex). Then the second man spoke up and said "The world has changed, and everybody just has to get used to it. You're never going to get an OSL, because nobody is ever going to sign your petition. You're just wasting your time."

Just then, another patron reached for a flyer and said "What's this?" And I said in a real loud voice so everybody could hear: "This is the new Anti-Baby Rapist Law that we are going to be collecting signatures for in January." 40 people came over and took all of the rest of the flyers I had. People were saying "I want to sign it right now!" Here is the very sad fact of the matter. We can't get rid of the 245 freaks that hold our whole city hostage, until they create 245 new victims. Doesn't that just suck? I went back to my shop to print up another 100 flyers, and went around town until midnight passing out flyers to enthusiastic future volunteers, everywhere I went. Everybody I talked to said they were going to tell all of their friends and co-workers. Many wanted flyers so they could go around and pass them out as well. It was a fun evening. I think we have the predator industrial complex vastly outnumbered.

Our lawmakers don't seem to care that kids are molested all the time. We free pedophile type sex offenders from jail all the time. They get out and go on to do it more. Some go on to kill i.e. John Evander Couey. He abducted and killed 9-year-old Jessica Lunsford. Joseph Edward Duncan III molested Shasta and likely killed Dylan Groene and the rest of that family.

KOMO4 TV News reported this evening that WA state could have kept Joseph Duncan III behind bars, but because the Department of Corrections couldn’t prove that Duncan would reoffend they had to let him go.

What kind of crazy logic is this and who are these people running our prison system anyway? Oh, I forgot! DOC Chairman Joseph Lehman SR. is the father of a man who raped a two month old baby! Yes, you read me right. His son raped a two month old baby. His son raped his granddaughter.

That’s who’s running this system!

Victoria Roberts, chairman of the DOC’s End of Sentence Review Committee stated that 'You have to be able to prove they are going to reoffend in a sexually violent, predatory way.'

Oh, really Ms. Roberts? Didn’t you just admit that Duncan wouldn’t stop talking about how he wanted to rape little kids.

The rapists, kidnappers and molesters have no problem talking about their demented plans yet how can it be that those we put in these positions to oversee these sexually demented creatures don’t understand how serious this “sexually deviant chatter” is.

It doesn't take a brian surgeon to figure out that people the DOC labels “Level Three” sex offenders are most likely going to reoffend. DUH!

1. Donate to Citizens for a One Strike Law --The most frequently asked question of me is, "Are you going to refile in January.?" The answer is, No! UNLESS we can raise the money. Believe it or not it costs about $400,000 to get an initiative to the ballot. However, with an active volunteer base it doesn't have to cost that much at all. If I can raise half that amount and get at least 2000 volunteers willing to collect at least 120 signatures I will refile in January.

Let them know we are here to work to change these laws. You can print up what ever information you need off the website (Just give credit to those who created the information).

5. Contribute local information to the website --What's going on in your part of Washington? We want to know. Your community is just as important as any other community in this state or other states. Send us your local news stories with added links for the website. The more evidence we have the better chances we have to convince legislators that we are right. This applies to all other states that have a CFAOSL chapter so please let us know.

6. Become an Area Coordinator (AC) -- Even if you live in/outside of Washington we are looking for anyone with a sound mind to become an area coordinator. CFAOSL is expanding to other states now and we are looking for those who would like to become AC in their community/states.

7. Ask your Legislators to support a one strike law bill or a possible future one strike law initiative. -- Don't take no for an answer! They work for you!

What are our priorities?

Dear One Strike Law Supporters and Media,

My team and I have worked diligently for two years to get sentencing law re: violent sex crimes changed in this state to no avail, but we keep on trying.

I am joyful to hear that Shasta Groene has been found alive. What I am sad, confused and angry about is that, we as citizens of this state, can raise $100,000 in ONE WEEK to make sure our gas taxes don't go up, but CFAOSL can't raise any money to pay for signatures to get strong sentencing law for violent sexual predators on the ballot. Why is that? Why do we not care about the safety of innocent life?

This man who kidnapped, raped, and murdered two innocent children was FIRST convicted in Pierce County! These Idaho citizens, including a 13 year old boy and a nine year old boy would still be alive if Washington had a one strike law for violent sex offenses. But we'll make darn sure our gas taxes don't go up!

When are we going to start caring about sex crimes to the point that we will raise money, collect signatures and devote ourselves to putting sexual predators behind bars for life? It would only take 6 months of dedication to change our laws and take a national stand against this trend in taking other people's children to commit heinous acts against them.

We have confused priorities. Yes, it matters that we don't allow this government to run rough shod over our pocket books and property! Yes, that matters. But it also matters that this government has and is creating more government jobs out of the sex offender industry and we stand by and let it happen! Bureaucrats have created a pedophile industrial complex and a jobs creation program off the innocent lives of children. Do the research and it is the only conclusion a sound mind can come to.

Please help me to change our laws to put dangerous and violent sexual predators behind bars for life, so we can stop predators in their tracks. In the end, we save tax money and more importantly we save human life.

In reading this letter we get the rare insight from the predator's point of view. And what a sociopathic view it is! He goes to great lengths to deny his participating in hurting innocent people. As all sociopaths do, they act like victims and deny their role in creating chaos and heartbreak. He does a good job of creating his reality and then he trys to convince us that the system he chose to get wrapped up in is wrong and vicitmizing. What-Ever.

He wants me to broaden my view and share my empathy with Violent Sexual Predators? Why would I do that? Why would I empathsize with a pervert bent on hurting others?

He whines about being labeled a SVP (Sexually Violent Predator). Cry me a river! How about the property owner who has to live next to level three sex offenders? The kids are locked away in their own homes so as to be protected from people who choose to hurt the innocent. Except for the real daring violent sexual perverts who go right into people’s home and steal their children right out of their beds!

How about empathzing with a kid who has been raped by child rapists like you Mr. Love? He whines that he is locked up for life? So is the kid who has been raped and molested.

As far as I am concerned Civil Committment Centers are unconstitutional and anyone convicted for the kidnap, rape and molestation of ANYONE should be locked up for life in PRISON. Not in some useless committment center teaching these “people” how to hold the hands of other pervs while they hold each other accountable! Yeah Right!

The KumBiYa Center is the result of a politically correct society instead of a society utilizing commen sense or a society who protects its weakest members.

What's next? A law that mandates the victim and the perv living together until we all "get along".

I sincerely hope that your in the best of spirits and physical health. I know that sex offenders are horrifically debilitating and leave tremendous long lasting suffering in their wake. It is said that a society is judged greatly on how that society's treat its young, aged/old, the disabled, the weak and the sick.

In that regard, America and many other countries have in place Laws, services to tend to its citizens needs and elements for their protection from societal fabric destroying crimes. Also, Amercia as well as some other countries, has a Consitution, and subsequently a system of laws to protect the innocent as well as the guilty.

In your letter rePrinted in the Bulletin, you don't mention those ex-felony offenders with sex convictions released via bein(g) deduced and adduced not to have a mental abnormality, thus Pose no future risk of committing crimes of sexual violence. Therefore, I surmise that you at least partially agree that on(ce) an individual has served his time, he Should be given a chance to redeem himself, give back to society, and leff(sic) alone to live his life?

Tracy I pray that "NO" Person released or post-confined reoffends in any kind of way, you know, I really hate it when the statistics Proves my Point, because I Know another child, teenager, adult an elderly Person, etec., has been violated.

Tracy, here at the Missouri Sex Offender Treatment Center, all of us Detained or Committed has a birds eye view of the Prison, Farmington Correctional Center, Seperated from us by a fence. Missouri has nurmous Prisons and many of us have been in several of them becasue of the D.O.C.'s Policy of moving inmates around on a constant basis. Therefore, those of us here Know No too well of the elements that we served time with and the Nature of their crimes. I have been convicted of being a "Sexually Violent Predator", however, the Nature and scope of crimes committed by those I served time with scares me beyond belief even. Those People are not here. As I've said in the following letter, mostly what the state of Missouri has confined/Post-incarcerated here is old, sick, and physically over the hill people, some don't have enought strength to pull the hat off of one's head. The situation I just mentioned abounds in all Post-Prison alleged civil committment centers, Nation wide. If you could read some of the reports on conditions of confinement, you possible could redirect your most welcome caring about what happens to children and others to reflect a broader view-coupled with your empathy and sympathy and Protection advocacy for children and others-you could get to know those who have committed sexual crimes, especially alleged SVP's, therefore helping to abate sexual offending from a multi-Plicity of directions.

I apologise(d) to law abiding citizens for my past criminal behaviors, I apologize(d) to other felony offenders for dropping the ball, by committing a crime. I cannot change the Past, however, I will do my best to affect a Positive future, Tracy-I know that its hard to "forgive" but its the way of healing.

Tracy, before I get on down to the reason I am writing you; I'll share the following quote I happened across, which is integral to my rebuttal to your letter reprinted in the Lifers Union Bulletin: ["All communication has a moral dimension" "People grow or diminish in moral stature by the words which they speak and the messages which they choose to hear."]

Tracy, I read with great disgust and dismay your uninformed and jaundiced tirade via your letter, "WHY PAY MILLIONS FOR "PREDATOR PLACES", reprinted in the December, 2004 Lifers Union Bulletin, page 8. While I will not attempt to obfuscate or dismiss your concerns, I will convey some of my thoughts concerning much volatile matters at the public's table. [NOTE: In rebuttal to your letter, I'll use the term [ex-felony offenders with sex convictions/felony offenders with sex convictions] instead of convicted sex offender(s) or "violent sex predator(s)."

In your letter you raised several questions concerning Federal Judge Robert Lasnick's lifting the 11 million dollar fine off of the State of Washington pursuant to the Special Commitment Center's compliance to the lions share of the late Judge Dwyer's ruling on the conditions of confinement ; Turay V. Weston. Tracy, I'll give rebuttal to some of your questions and assertions:

1. You questioned "if the treatment sex offenders is so good then why not lift the "level three" (highly likely to re-offend) label tattooed on their backs?"

My rebuttal to your horrendous/pejorative question is very simple: You have formed an opinion of people whom you know nothing of them or their particular circumstances. I am amazed that you think the way you do in the factual face of the hundreds of innocent human beings extricated from America's death rows [and] the thousands of innocent human beings extricated from many other forms of false imprisonment across America. A study/report issued (2005) by the American Bar Association, factually revealed a "tip of the iceberg;" ["More than 150 people convicted in 31 states and the District of Columbia served a total of 1,800 years in prison for crimes [they did, not commit.] All were exonerated via DNA. The study/report goes on to say ["Thousands of suspects unable to afford lawyers are wrongly convicted each year because they are pressured to accept guilty pleas or have incompetent attorneys."]

2. Tracy, you asserted “your are not opposed to lifting the 11 million dollar fine on TAXPAYERS of Washington.

My rebuttal to your assertion Ms. Tracy Oetting is: 11 million dollars is chump change compared to the millions Washington state and other states with SVP Statutes spend to keep confined [ex-felony offenders with sex convictions] after they've completed the provisions of consummated contracts/plea bargains. The names of SNOHOMISH COUNTY AND the City of SKYKOMIS are of Native American origin, therefore, I am sure the folks up around there are very familiar with the legacy and litany of broken contracts/treaties in this hemisphere.

3. You assert that lifting the fine is a good idea, however, you question the quality of treatment warrants lifting the fine?

My rebuttal is simple Tracy: I believe in treatment! I don't believe in POST-INCARCERATION IN THE NAME OF TREATMENT. I believe that treatment should be [OFFERED] to all convicted offenders the moment they enter prison, no matter the nature and scope of their crimes. Factually, all crimes have the propensities to escalate and or morph. A purse snatching can escalate and or morph into a car jacking in the assailant's bid to escape the scene; home invasion and additional robbery if the assailant decides to go to the car Jacked victim's house; sexual assault/rape and ultimately murder are also possible. Tracy, all endeavors whether positive or negative intentions, have the propensities to spin out of control; [ESPECIALLY] criminal intent has the [propensity to go even more terribly wrong for victims] as in the purse snatching example.

Tracy, if you want something to rail against, you should admonish the State of Washington and other states for claming that through [flash, drive-thru, drive-by] evaluations, state agents such as psychiatrist and psychologists, can deduce and adduce which [felony offender with a sex conviction(s)] poses a threat of future sexual violence if not confined. Tracy, while I believe that the fields of Psychiatry and Psychology are valuable and viable professions/tools, especially when used to help individuals sort out their problems [and] help individuals acquire diversity in their dealings with a complex society and world; I do not believe the fields of Psychiatry and Psychology should be used to imprison [ex-felony offenders with sex convictions] exonerated via consummated contracts/plea bargains. [We (they) have committed no new crimes, thus are [ex-felony offenders with sex convictions.]

Sadly, the prestigious professions of [Psychiatry and Psychology] and the behavioral science community in general are used to manipulate institutions and railroad people into institutions via rogue, self-absorbed, racketeering psychiatrists and psychologists who claim they can predict future behaviors. Among other things, their respective behaviors amounts to scrubbing out the lines between psychiatry, astrology, psychology, soccer, astronomy, fortunetelling, etc. As opposed to the behaviors of the aforementioned rogues, the American Psychiatric Association and the American Psychological association has said as much when they stated: ["We do not have the (tools) nor expertise to predict future behaviors [and] that SW Statutes and subsequent treatment programs are an abuse to our respective professions [and] an abuse to the individuals detained and or committed is such programs."]

4. Tracy, you stated that "the term ("violent sex predator") is a label a judge orders to an individual who is especially vicious in the crimes they have committed and they all live on McNeil Island soon to be living in SCTF's [Secure Treatment Facilities] around the state."

My rebuttal to your concern is that "two wrongs don't make a right" Let me remind you that Native Americans were the victims of one the most horrific sex crimes on the planet via European expansion into this hemisphere. More Native Americans died from [sexually transmitted diseases] than bullets, vetted upon them by malcontents among explorers. It seems it was a humongous and unpardonable crime for "A People" to be in possession of Billions if not trillions of acres of pristine prime real-estate, punishable by humiliation and usually death. General Andrew Jackson augmented this disgusting treatment with his statement and subsequent actions after Chief Justice John Marshall/U. S. 5. Tracy, you alluded to viciousness of crimes committed by individuals dubbed "violent sex predators" and the possibly of them living in SCFT's in your neighborhoods.

My rebuttal to your concerns is: ["The Constitution of the united States is a law for rulers and people, especially in war and in peace, and covers with the shield of it's protection all (classes) of men, at (all) times, and under (all) circumstances." "No (doctrine) involving more pernicious consequences was ever invented by the wit of man than that any of it's provisions can be suspended during any of the great exigencies of government" "Any (doctrine) contrary leads directly to (anarchy) or (despotism.") , Ex-parte Milligan, U. S. Supreme Court] Also: [Anacortes, Washington: Meeting on Sex offenders goes beyond stereotypes: "The panelist said that known sex offenders are only a piece of the problem. They emphasize that only about 2% of sexual assaults involve strangers. The vast majority of sex crimes are committed by persons who are (known) and (trusted), such as family members, friends, neighbors or baby sitters. 98% of sexual offenses caused by trusted person. 2% of sexual offenses caused by strangers." April 9, 2003 Anacortes American.] ["All of you have lied, all of you have said something wrong, all of you have dirt." "When your closet is clean, come clean someone else's, but clean yours first" "You guys need to turn the page." Barry Bonds.] Barry Bonds had some interesting comments that are unrelated directly to the matter we're discussing, however, Tracy, while I am not privy to whether Barry Bonds used steroids or not, Mr.. Bonds' words ring with resounding veracity across a broad spectrum of material at the public's table. For instance, The numbers released by the U.S. Justice Department, Bureau of Justice Statistics reveals there's been lots of buck passing, lots of lying, lots of professional malfeasance, especially exuded/demonstrated by rogue, renegade psychiatrists, psychologists, and others in behavioral science, [and] such fields as neurology/neurolgenetics and neuropsychiatry/psychology, etc., who are tainting their respective fields via wallowing in what they know to be flawed research/results, thus they criminalize themselves by spewing toxic, invalid and liberty stealing testimony in courts of law.

This is tyrannical power, and it should offend anyone who cares about the rule of law, checks and balances and constitutional guarantees." "Although this nation must take strong action under the leadership of the Commander In Chief to protect itself against enormous and unprecedented threats, that necessity cannot negate the existence of the most basic fundamental rights for which the people of this country have fought and died for well over 200 years." "A government with the power to spirit people away and declare that that's the end of the matter is exactly the kind of governments the United states has always claimed to oppose and sometimes fought" "For the United states now to become that kind of government is spectacularly scary." 7. Tracy, you asserted that "these predators are kidnappers and murderers who perpetrate violent sex crimes. "Victims are mostly likely women and children and your state legislators passed laws allowing them to get out." "It takes an evil person who commits an evil act to get this special label." "Now a judge is saying that the treatment the state is offering is so good we get a relief order of 11 million dollars." "This doesn't make sense to me."

My rebuttal is; Tracy you should desist in taking as face value the labels the State of Washington and other states issue with total abandon. Do your own investigation in the form of comparable analyst, keeping in mind that initially and ultimately the citizens will bear the brunt of criminal assaults and criminal intentions no matter the social, criminal and mental history of a released felon, [if] and [when] he or she chooses to act out criminally: A. Washington State's SW is retro-active. I am sure you'll be surprised at the horrendous amount of [ex- felony offenders with sex convictions] released without evaluations because Washington's SVP had not become law when they neared and or completed their sentences. B. Check the ages, medical and physical conditions of those detained and or committed at SCC compared to Washington's releases. Here in Missouri the lions share of detained/committed are realty old and in sad medical conditions. They have severe medical problems that require massive amounts of drugs. There are several in wheel chairs. In other words, they are not the strapping young bucks the state routinely releases without compunction. C. Check the criminal and mental records of those detained/committed against those released. Here in Missouri the state has detained/committed many who have no criminal record except the one sex conviction. D. Check to see how many felons with no sex convictions of record committed sexually violent crimes once released. E. Check to see how many: 1. Sex convictions those detained/committed have and the number and duration of prison stints they served for sex convictions and other convictions. 2. Check the number of sex offenses and prison stints served by those released who had sex convictions. Tracy, when you finish checking, I am sure you'll question the fiscal sense of spending millions on millions of dollars to keep confined men who have served their prison time. Not only do Americans deserve to be protected from crime and criminal assailants, Americans need to be protected from legislative and judicial fraud; legislatures and legislators seeking accolades by scapegoateing [felons with sex convictions], in a bid to mask the sordid past and present nature of politics [and] their participation in it. Judges, instead of maintaining fidelity to the Constitution, are succumbing to their internal indiscretions [see Anita Hill V. Clarence Thomas] in making rulings that don't reflect Constitutional Law.

8. Tracy, you asserted, "when one of these violent sex predators re-offends well sue you." "we'll sue the treatment providers, the legislature, the Dept of Corrections, the Sentencing Guidelines Commission and anyone else who says that these people are safe to live in our communities and hasn't recommended to the legislature to pass a "one strike law" for violent sex offenses." "It is time the government does its job and pass laws that protect those of us who pay their salaries and support their life styles instead of relying on the bad guys to keep government in business."

Tracy, in rebuttal let me say that I am astounded by your incredulous and curmudgeon attitude and outlandish assertions. I am certain you'll have to stand in a very long line if you plan to sue the State of Washington and it's agents and all the others you seem to demand that they enlist in your particular brand of hate. I am curious, will you push to apply the "one strike law" to all of those executives that [looted] public and private corporations/companies, thereby robbing millions of hardworking "TAXPAYERS" of jobs/"salaries" and vital pensions funds/benefits? Think if you will, of the many senior citizens who can't afford their medications, decent food, mortgage payments, etc., because of the unchecked greed of corporate rogues. Do those looters make good neighbors?

9. You said earlier in your letter that the "violent sex predators in Washington should have "level Three" tattooed on their foreheads instead of their backs where you first suggested they be affixed.

My rebuttal is simple; Since you seem thrilled with such sadism, maybe you'll dance with glee to the fact that over 90,000 prison inmates [over 32,000 in Missouri and over 60,000 in Illinois] faced potential lethal food poisoning via adulterated foods/meats delivered in tons by a food company based in Missouri. Also, this food company delivered foods/meets to numerous mental health facilities, juvenile facilities, homes for the mentally retarded, etc., in Missouri and Illinois. Two top executives of the food company recently pleaded guilty in Federal Court, Eastern District of Missouri, to charges which described their [violent], dangerous, reckless, asinine, unconscionable and reprehensible conduct Hey Tracy, how's about applying the "one Strike" law to the food executives that perpetrated such evil? Or would you negate the abominable actions of rogue food company executives as ["collateral damage"] since their greed could have wiped out the "bad guys" that "state legislators and others rely on to keep government in business, as you stated in your letter that Washington officials rely on the "bad guys/violent sex predators to keep government in business? Tracy, those food company executives are living in a neighborhood as we speak. How's about the executives of W. R. Grace Company who knowingly poisoned an entire town, Libby, Montana; great neighbors "huh"? Excuse me, I forgot its not considered a mental abnormality if one can control his or her behaviors, but chooses to make wrong/bad decisions? Tracy are you oblivious/lacking conscious awareness because of the sheer immensity of those executive(s) crimes?

Napoleon Bonaparte 1789] Tracy, looking at Napoleon's style of doing business, [if I didn't know any better, I'd swear Napoleon Bonaparte wrote the SW Statutes enacted by several states?] Tracy can you ascertain similarities in your letter reprinted in the Lifers Bulletin and Napoleon Bonaparte's enlightened despotism?

Tracy, it is tantamount that offenders show sincere remorse and empathy for all victims of all crimes. Its equally tantamount that the U. S. Government and it's political subdivisions called states, exude/demonstrate empathy and deference to victims of all crimes. Violating the law of the land [the U.S. Constitution] will not provide solace nor peace to any suffers nor will a conducive environment and atmosphere exist pursuant to positive change for felons and deter would-be felons.

It is the states speaking no matter which agent(s), agency(s), Dept(s), etc., it speaks through. Therefore its unconstitutional for states to have legislative sanctioned due process for some felons and legislative placebo due process for other felons. This hypocrisy must cease. For example, U. S. Supreme Court Justice Clarence Thomas asserted ["I grew up under segregation in Georgia. There were two sets of books, one when you were light complexted and one when you were dark. I an not going back to two sets of books."] Yet we see that Justice Thomas has indeed embraced "two sets of books" by voting to uphold SVP Statutes as constitutional. What's really disconcerting is that we know that something is terribly wrong when the U. S. supreme Court, subsequent Federal Courts, state courts, state legislatures/legislators, prosecutors, psychiatrists, psychologists and some felony offenders are willing to hide behind such a ridiculous fantasy that citizens are some how less impacted if they are assaulted by felons who just happened to make wrong/bad decisions [whereas] citizens suffer irreparable damage if they are assaulted by felons who are alleged to have a so-called mental abnormality. It is unconscionable, reprehensible that a cavalcade of human entities claim to care about citizens and public safety, yet impulsively hide behind a conglomeration of rhetoric written into contagiously unconstitutional laws that are virtually impossible to vet/subject through, pursuant to eliciting justice or any semblance of justice. To elaborate, Ill divulge an excerpt from closing arguments by Mo., Asst, General David Hansen, Esq., in my 2nd civil commitment trial, (1' trial over turned/Mo., Ct. App.). Then I'll divulge excerpts from statements made to investigators by Charles Hickman, confessed killer of 10 year old Katlyn Collman, January 2005, Brownsville, Indiana. Hickman's accomplice was Timothy G. O'Sullivan.

[Mo., Asst Attorney General asserted to the court and jury: "And the purpose behind the standard is how do we distinguish a person, a sexually violent predator , someone that needs commitment for treatment, from someone who is an "ordinary criminal recidivist. That's the language the U. S. Supreme Court used in Crane." There's not some magic to this formula; its what the experts need to look at is, this person is different than an "ordinary criminal recidivist." "Are we trying to commit somebody that "JUST" goes out and commits a "VARIETY" of crimes, or is it somebody that has a mental abnormality that makes it difficult to control their behaviors, such they need to be confined to treatment because [they are dangerous to others." David Hansen, Missouri Assistant Attorney General]

Charles Hickman confessed/asserted to investigators: ["We abducted her [Katlyn Coltman] "JUST"" to scare her into keeping quiet about our drugs; our methamphetamine activities in the (her) neighborhood."]

Tracy, the surreal ness of the U. S. Supreme Court's un-judicious rthoric/ruling, parroted by Mo., Asst, General David Hansen Esq., is reflected in Charles Hickman's cavalier/off hand disregard for his murderous actions [and] his [rational] for his and his accomplice murderous actions. A casual search, even, of jurisdictions across America will reveal many shocking crimes committed by "dangerous but typical recidivist and or "ordinary criminal recidivist" True to their aforesaid labels [courtesy of the U. S. Supreme Court] describing them and pursuant to their horrific criminal actions defining them, it behooves me to call on all Americans to aid in dismantling SVP STATUTES. Simply because I believe that those who had impute in the fabrication and enactment of SVP STATUTES [and] the sustaining of SVP STATUTES, are obviously still vacationing aboard the [KNOW IT ALL VESSEL„ U. S. S. "PEDANTIC"] reminiscent of the ill-fated VESSEL [H. M. S. "TITANTIC"] traveling way too fast in the iceberg infested North Atlantic.

There is no dispute that making errors in judgment, some horrific, is not a domain exclusive to convicted felons. No human being is guaranteed that he or she will transverse their mortal spans without some derelictions. No crimes are pretty; no massive demonstration of humans inhumanities to other humans via political ambitions or ineptness are pretty. Tracy, I am an [ex-felony offender with a sex conviction], however, I am a sponge for positive character strengthening knowledge, postures and affections, thus I [reject] being habituated on by those human entities who claim the impossible; that they are privy to my immanence and itinerary. Like all Americans, I am [obligated] to obey laws enacted by duly constituted assemblies, however, I am not by any stretch of the imagination [obligated] to agree with laws repugnant to the U. S. Constitution or laws that repulse me personally.

Tracy in conclusion, I'd like to ask you a question: Considering the labels "dangerous but typical recidivist" and or "Ordinary criminal recidivist" who are alleged to have volitional control but choose not to control their behaviors, thus are prone to make wrong/bad decisions [as] opposed to the alleged "Sexually Violent predator" allegedly lacking volition, thus cannot control his behaviors; can it be predicted at what juncture the individual that chooses to make wrong/bad decisions and the alleged sexually violent predator, act out [if] and [when] after release from custody? A. 10 minutes after release? B. one day after release? C. six months after release? D.. 2 years after release? E. five to ten years after release? F. Fifteen to twenty years after release? Its been documented that many of those deduced and adduced [not] to be SW's, thus released, have recidivated to prison with sexually violent crimes and other violent crimes.

Tracy, I am sending a copy of this letter to Alan "Big Al" Meirhofer, Vice President and Director of Distribution, Lifers Union Advocacy Group/Lifers Union Bulletin. I’ll request that "Big Al" print your letter again along with [this] my letter in the Bulletin as to achieve a level playing field for those of us illegally confined, oppressed and repressed [and] for people as yourself Tracy, who feel they are getting the same sordid business.
